TOWN OF CONCORD PLAN COMMISSION MINUTES

April 26, 2023

The meeting was called to order at 7:15 p.m. with Plan Commission members Jim Gilbert, Sally Williams, Lloyd Zastrow, Kim Miller, and new member Dave Wegner present.

The meeting was opened with the Pledge of Allegiance.

Sally Williams stated that the meeting had been properly posted.

Jim Gilbert made a motion to approve the minutes from the January 25, 2023 meeting, second by Kim Miller. All approved. Motion passed.

James Gesell presented a petition and preliminary CSM to create a 1-acre A-3 lot from a 15.8-acre A-1 parent parcel at W2245 County Road B (parcel # 006-0716-1813-005). Mr. Gesell stated that the land is 3-prime, it has some buildings on it and has not been farmed for many years. Discussion centered around the county zoning code in relation to lot splits. The county allows 3 non-prime splits per parent parcel OR 1 prime split. Only one option is allowed. Since there has already been one non-prime split on this parcel, no prime split would be allowed. The Town Plan indicates that the town will follow the county rules in relation to prime splits. In the past this has always been objectively based on the soils map to determine prime vs. non-prime. There are no criteria with which to consider a prime split to be non-prime. Therefore, any such determination would be subjective and arbitrary.

Sally had talked to the zoning office and they indicated that the county zoning committee may be open to considering this a non-prime split because of the presence of the buildings and the fact that is hasn’t been farmed. Lloyd felt that with the building and building foundations, this is non-farmable and should be considered non-prime.

Dave Wegner made the point that any driveway off this lot would be a hazard for traffic on Hwy B from the west as it just over a hill.

Lloyd made a motion to approve the petition, second by Jim. Jim and Lloyd approved. Dave, Sally, and Kim opposed. Motion failed.

With no further business, Lloyd made a motion to adjourn, second by Jim. Meeting adjourned.
