TOWN OF CONCORD PLAN COMMISSION MINUTES
April 24, 2024
The meeting was called to order at 7:00 p.m. with Plan Commission members Jim Gilbert, Sally Williams, Kim Miller, Dave Wegner, and Lloyd Zastrow present.
Sally Williams stated that the meeting had been properly posted.
Jim Gilbert made a motion to approve the minutes from March 27, 2024 meeting, second by Dave Wegner. All approved. Motion passed.
Item 1: Scott & Joyce Schiefelbein requested review and approval of a preliminary CSM to rezone from A-1 to A-3 from parcels 006-0716-2212-000 & 006-0716-2213-000 and from A-T to A-3 from parcel 006-0716-2221-005 to create a 2.2-acre lot at N6002 Grey Fox Trail.
There was considerable discussion regarding the size of the lot. The bulk of the lot would be from the 20-acre parcel 006-0716-2213-000. As currently presented 1.5 acres would be used for driveway access and the lot area itself would be only .7 acres. The current preliminary survey would leave a strip of A-1 land to the south of the driveway that is approximately 80 ft wide and 435 ft long. It would seem to make more sense to make this strip part of the lot. According the county zoning office, much of this land has unclassified soils which would be considered non-prime for the purposes of creating a lot so that the lot could be up to 6 acres. Mr. Schiefelbein is open to making the lot bigger. His intent is to sell the resultant lot together with the remaining A-1 land from parcel 006-0716-2213-000.
There was significant input from neighbors present as follows:
Chris Steinmiller, N5972 Grey Fox Trail, asked for confirmation that the access from Grey Fox Trail would only allow for access to only one lot and not multiple lots. He was informed it would be for one lot only.
George Staffin, N6045 Grey Fox Trail, was concerned about the slope of the driveway off of Grey Fox Trail and that the necessary grading would cause flooding of the property to the south.
Teri Fregien, N6032 Grey Fox Trail, expressed concern about potential conditional uses in A-3 zoning. She enjoys the current privacy of the area.
Dennis Moldenhauer, N6068 Grey Fox Trail, wanted confirmation that the access off Grey Fox Trail would be a private driveway and not a road. He was informed it would be a private drive.
Jeanne Peffer, N5988 Grey Fox Trail, felt that the parcel should be larger than 2.2 acres to fit in with the current sizes of the residential properties in the area which are 5-10 acres.
Robert Beres, N6021 Grey Fox Trail, questioned if the driveway could be paved or concrete. He was informed that it could be.
Matt and Laura Dressel, N5973 Grey Fox Trail, were not in attendance but sent an e-mail objecting to the rezoning request because they would like the area to continue to be rural with consideration toward preservation of wildlife and woodlands.
Mr. Schiefelbein will contact his surveyor to look into having a revised preliminary survey with a larger lot size.
Dave Wegner made a motion to table the petition, second by Jim Gilbert. All approved. Motion passed.
Item 2: Continued discussion of Town Ordinances Ch. 9:
Sally Williams discussed what parameters might go into updating the noise ordinance as our current ordinance is very subjective. It was decided that the issue would be addressed with the town board to see if they would like the committee to write up a more specific noise ordinance.
With no further business, Jim Gilbert made a motion to adjourn, second by Kim Miller. Meeting adjourned at 8:13 p.m.
